Terms and Conditions

A. General

1.Ownership: The Game is owned and operated byGIANG TRU SOFTWARE COMPANY LIMITED (“Company”).

2.Scope: These Terms and Conditions constitute a binding legal agreement between you and the Company, governing your use of any Games or Platform services provided by us across all electronic devices, including web, mobile, and tablet.

3.Arbitration Agreement: By accepting these Terms and Conditions, you agree to resolve any past, current, or future disputes with the Company through individual arbitration, waiving the right to participate in any class, group, or representative action, unless you opt out within the specified time.

4.No Real Money Gambling: Our Games and Platform do not involve real money gambling, and no purchase is necessary to participate. Only individuals residing in the United States (excluding Idaho and Washington) and Canada (excluding Quebec) are eligible to enter the Sweepstakes.

B. Participation

1.Eligibility and Warranties:

1.You confirm that you are at least 18 years old or have reached the minimum legal age of majority in your jurisdiction and are legally permitted to participate in the Games offered on the Platform.

2.You do not reside in or access the Platform from any Excluded Territories.

3.You participate strictly in a personal capacity for entertainment and recreational purposes only.

4.You are participating on your own behalf and not for any other individual.

5.You guarantee that all information provided by you during the validity of these Terms and Conditions is accurate, complete, and up-to-date, and you will notify us of any changes promptly.

6.You agree not to engage in any fraudulent, collusive, or unlawful activities related to your or others’ participation in the Games. The use of any automated methods, including bots, or unauthorized software is prohibited, and any such conduct may result in the invalidation of your participation.

2.Compliance: It is your responsibility to ensure your participation complies with the laws of your jurisdiction. Any breach of these Terms, including attempts to circumvent restrictions (e.g., using VPNs, proxies, or providing false location information), may constitute fraud and could lead to criminal prosecution.

C. Licence

1.Platform Access: Subject to your compliance with these Terms, the Company grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to access and use the Platform and Content via supported web browsers or mobile devices solely for personal entertainment purposes.

2.Avatars: You are granted a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to use avatars available on the Platform. Avatars may be added or removed at the Company’s discretion without notice.

3.Avatar Ownership: Purchasing an avatar grants a licence to use it as long as it remains available on the Platform.

4.No Ownership Rights: These Terms do not provide you with any ownership rights or interest in the Platform or its Content.

5.Licence Limitations: Your licence to use the Platform is contingent upon adherence to these Terms. Any violation may result in immediate termination of your access.

6.Legal Restrictions: If the Platform or any Game is illegal in your jurisdiction, you are not permitted to access the Platform or relevant Game.

D. Account

1.Single Account Policy: You are permitted to maintain only one Customer Account, including any inactive accounts. Attempts to create multiple accounts may result in the suspension or closure of all accounts.

2.Account Changes: Notify us immediately if you have more than one registered account. To update details such as your email, address, or surname, contact Customer Support instead of creating a new account.

3.Account Information: You must keep your registration details current at all times. Your registration name must match your government-issued identification.

4.Account Security: You are solely responsible for keeping your Customer Account login credentials and payment methods secure. Unauthorized use of your account, including by minors, is your responsibility.

5.Sharing Prohibited: You must not share your account or password with anyone else or allow others to use your account, as this compromises account security.

6.Compromise Notification: If you suspect that your account has been compromised, including unauthorized access or loss of credentials, you must notify us immediately.

7.Account Liability: You are responsible for all actions associated with your account, even if not performed by you. Unauthorized use that breaches these Terms or is illegal may result in termination of your account.

8.Third-Party Misuse: The Company is not liable for misuse of your account by third parties due to your disclosure of login details.

E. Fraudulent Conduct

1.Prohibited Actions:

1.Unauthorized access or hacking of the Games or Platform, including password mining or phishing.

2.Attempting to modify, reverse engineer, or disassemble any part of the Games or Platform.

3.Introducing malicious software, such as viruses, worms, or spyware.

4.Circumventing the structure or navigational functions of the Games to access restricted information.

5.Engaging in any form of cheating, collusion, or unauthorized collaboration.

F. Intellectual Property

1.Ownership Rights: All software, graphics, the Platform, and user interfaces provided to you are owned by or licensed to the Company or its affiliates and are protected by intellectual property laws. Use of these materials is restricted to personal, non-commercial use in line with all applicable laws and rules, including these Terms and the Sweeps Rules.

2.Content Rights: The Company owns or is an authorized licensee of all intellectual property associated with the Content on the Platform.

3.No Transfer of Rights: Using the Games and Platform does not grant you any intellectual property rights in the Content, Games, or Platform.

4.User-Generated Content: By publishing or uploading any content (e.g., images, videos, comments) to any Company-controlled website or social media, you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free licence to use the content at our discretion.

5.Content Restrictions: You are prohibited from reproducing or modifying any Content, including the removal of copyright or trademark notices.

6.Trademark Rights: All trademarks and logos on the Platform are owned by their respective proprietors and protected under applicable trademark and copyright laws.

G. Disruptions

1.Platform Provision: The Platform is offered "as is," without any warranties or guarantees regarding quality, fitness for purpose, or accuracy.

2.Liability for Disruptions: The Company is not liable for any service disruptions, technical issues, or unauthorized participation methods that affect gameplay.

3.Damages and Losses: The Company accepts no liability for damages or losses related to the Platform, including data loss, transmission errors, or unauthorized use. Gameplay is void in the event of system malfunctions.

4.Content Modifications: The Company reserves the right to suspend, modify, or remove any Content from the Platform at its discretion and is not liable for any resulting losses.

5.Temporary Suspensions: The Company may temporarily suspend the Platform or any part thereof at its discretion. We will restore services as soon as reasonably practicable.

6.Arbitration Requirement: Both you and the Company agree to resolve disputes through final and binding arbitration, as permitted by law.

H. Marketing Communications

1.Consent to Communications: By participating, you consent to receive marketing communications from the Company via email, post, SMS, and telephone. You may unsubscribe from these communications at any time.

I. Indemnity and Limitation of Liability

1.Indemnification: You agree to indemnify and hold the Company and its affiliates, directors, officers, employees, and agents harmless from any claims, liabilities, or expenses arising from your participation, including any fraudulent or unauthorized actions.

2.Limitation of Liability: To the maximum extent allowed by law, the Company and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits, revenue, or data, resulting from your participation or any actions or omissions by us.

J. Miscellaneous

1.Entire Agreement: These Terms constitute the complete agreement between you and the Company regarding your participation and supersede all prior communications.

2.Amendments: The Company reserves the right to amend these Terms at any time. Changes will be posted on the Platform and take effect immediately.

3.Notice of Amendments: If changes to these Terms limit your rights, you will be notified on your next visit to the Platform, and your continued participation will require acceptance of the new Terms.

4.Force Majeure: The Company is not responsible for any failure to perform due to events beyond its reasonable control.

5.Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be effective. Invalid provisions will be amended to reflect, as closely as possible, their original intent.

6.Language: These Terms may be translated for convenience, but the English version prevails in case of any discrepancies.
